General Terms & Conditions

These Terms & Conditions apply to all bookings made with Best 4 Travel (including bookings made in-store, over phone or by email). It is your responsibility to ensure that you have carefully read and understood these Terms & Conditions because, by making your booking with Best 4 Travel, you agree and acknowledge that these Terms & Conditions will be binding on You as well as the terms and conditions of any Suppliers relating to any Product purchased by you.

  1. Acceptance of Terms & Conditions
    • Best 4 Travel is a travel manager which provides you with the Services which allow you to purchase the Products from our Suppliers.
    • By paying the Deposit, you accept that the Itinerary is accurate, you agree to pay the Deposit & the Total Price (by the due dates specified in the Booking) and you agree to, and will become bound to, these Terms & Conditions.
    • If you are making this Booking on behalf of other travellers, you warrant that you have the authority to make the Booking for all travellers and agree on behalf of the other travellers to bind them to these Terms & Conditions, in particular, our Terms & Conditions in relation to changes and cancellations (see clause 4 below).
  2. Booking & Payment Terms
    • To secure your Booking, you are required to pay the Deposit by the due date specified in the Booking. If you fail to pay the Deposit by the due date, the Quotation will immediately lapse and Best 4 Travel will be unable to secure your Booking. In these circumstances, Best 4 Travel will be required to prepare a new Quotation in which the Itinerary and/or Total Price may change.
    • Upon paying the Deposit, you:
      • agree to the Booking;
      • accept these Terms & Conditions;
      • agree to pay the Total Price by the due date specified in the Booking, failing which you acknowledge that the Total Price may change without notice and/or your Itinerary may be cancelled and/or changed without notice;
      • acknowledge that the payment of the Deposit only secures your Itinerary, it does not secure the Total Price which may still change until the Total Price has been paid in full; and
      • acknowledge that Best 4 Travel will take steps to secure your Booking which will result in Best 4 Travel incurring costs on your behalf and accordingly, the Deposit will be non-refundable and/or cancellation fees will become payable in accordance with these Terms & Conditions (subject to your rights under the Australian Consumer Law).
    • Best 4 Travel makes every effort to ensure the Booking is accurate and correct, however, Best 4 Travel is an agent which relies on the information provided to us by our Suppliers and accordingly, until the Total Price is paid in full, the Booking will remain subject to availability and can be withdrawn or varied without notice. The Total Price is only guaranteed once the Total Price has been paid for in full and relevant tickets have been issued by the Supplier.
    • Price changes may occur until the Total Price is paid in full because of matters outside our control which increase the cost of the Product or Service. Such matters include, but are not limited to, adverse currency fluctuations, fuel surcharges, taxes and airfare increases. Please contact your consultant for up-to-date prices. Where possible, we will bring any price changes to your attention as soon as possible after we become aware of them.
    • If you fail to pay the Total Price by the due date specified in the Booking, you agree and acknowledge that:
      • your Booking may be cancelled by Best 4 Travel and/or any Suppliers (which will be beyond the control of Best 4 Travel); and
      • the Total Price and/or the Itinerary may change without notice;
      • the Deposit, which represents a reasonable pre-estimate of Best 4 Travel’s costs and the non-refundable costs paid to Suppliers, is non-refundable; and
      • further cancellations fees may be charged in accordance with these Terms & Conditions.
  1. Booking Details & Travel Documents
    • It is your responsibility to ensure all details of the Booking, including but not limited to names, dates and Services booked on the Itinerary, are correct.
    • Travel documents include, but are not limited to, airline tickets, hotel vouchers, tour vouchers or any other document used to confirm an arrangement with a Supplier. Travel documents may be subject to certain conditions and/or restrictions including, but not limited to, non-refundable terms, fixed date terms, and/or subject to cancellation or other change fees. Travel documents cannot be transferred to another person to use.
    • For Bookings for international travel, we will require a copy of your passport prior to departure. It is your responsibility to ensure the names on the Itinerary match your passport, otherwise strict fees may apply if corrections need to be made. Do not use nicknames, known-by names, or abbreviated names.
    • Due to possible schedule changes by Supplier airlines, it is also important, and your responsibility, to check departure times, and check-in times when reconfirming flights and on the day of departure.
    • Special Booking Requirements

Please contact your consultant on (08) 9203 7555 regarding any special requirements you may have for your travel arrangements, such as special meal and seating requests, room type or disabled access. However, we cannot guarantee your request will be accommodated because all such requests are beyond our control and subject to the absolute discretion of the Supplier.

  • Payments
    • Direct deposit and cheque payments cannot be used for instant purchase rates and must be made prior to the invoice due date to allow sufficient processing time for funds to clear into our account.

  • Cheque payable to Best4Travel.
  • Credit Card – please note MasterCard and Visa cards will incur a 1.5% surcharge, which may change without notice should the surcharge charged by our providers change (we note that the surcharge will always reflect the surcharge charged by the relevant provider). You authorise us to charge all fees incurred by you in relation to the Services provided by us to the credit card or debit card designated by you. If payment is not received from the card issuer or its agents for any reason, you agree to pay us all amounts due immediately on demand.
  • Cash& EFTPOS are accepted. Please note that we are unable to accept cash payments of $10,000 or more per booking, including multiple payments for the same booking which total $10,000 or more. Cash payments of less than $10,000 per booking can be accepted.
    • Monies not held on trust

You agree and acknowledge that:

  • any monies paid to us by you is not held on trust for and on behalf of you;
  • we may deposit and/or hold such monies in any account we see fit;
  • all such monies are the property of Best 4 Travel and will be a debt due and payable to the Supplier in accordance with the terms and conditions agreed with that Supplier; and
  • in the event we retain the monies, and you are entitled to a refund, if any, then we will only provide that refund to you once we are authorised by the Supplier to process the refund.
  • Additional Supplier Charges
    • Some Suppliers may charge additional fees which are not included in the Total Price and will be payable by you. For example, some airlines may charge an additional fee for baggage, in-flight food, drink, and entertainment.
    • Please note that not all airfares include checked baggage and further fees may apply. Further, your checked baggage allowance, if any, will depend on the Supplier, your travel class, and your flight destination. It is your responsibility to acquaint yourself with the relevant baggage allowance and applicable baggage fees.
    • There may be local taxes or fees payable on arrival. We will endeavour to include such fees in our quotations, however, do not guarantee the amounts.
    • Any additional Supplier fees and charges will be payable by you directly to the Supplier at the time. Please contact the relevant Supplier for full terms and conditions.
  • Taxes
    • Where GST applies, our prices are inclusive of GST unless otherwise stated.
    • Airline taxes are subject to change and are confirmed at the time your airline ticket is issued. There may also be a local tax charged at some airports.
  • Currency

Our prices are quoted and processed in Australian Dollars ($AUD). Payments processed in foreign currency may incur a currency conversion fee. Please contact your financial institution for applicable fees.

  1. Booking Changes & Cancellation
    • Charges and/or fees may apply to your Booking as set out in these Terms & Conditions. These charges and/or fees reflect reasonable, direct and indirect costs, time and effort incurred and involved in us providing our Services to you, and processing and managing changes to, or cancellation of, your Booking.
    • Please contact your consultant for further details relating to your Booking, including your Itinerary and any Booking change or cancellation fees and charges.
    • Booking Modification
      • We will do everything reasonably practicable to accommodate any requested amendments to your Itinerary. However, any amendments requested after you have paid the Deposit, or Total Price, may be non-refundable and non-changeable, and/or incur fees from the Suppliers and/or Best 4 Travel.
      • Any amendments required after you have paid the Deposit, or Total Price, whether on request by you or Suppliers, or which are required because of any change to immigration and border arrangements, will incur a service fee of $75.00 per hour payable to Best 4 Travel.
      • Supplier fees may also apply where your Booking is changed and requires tickets or other travel documents to be re-issued.
      • Please note that the payment of the Service Fee will not guarantee that the Supplier will agree to any modifications to your Booking.
    • Cancellation by You
      • Upon making a Booking with us, we will incur direct and indirect costs on your behalf (including third party travel service providers) and will also spend a considerable amount of time and effort in securing your Booking. Accordingly, if you cancel all or part of a Booking, for any reason whatsoever, you agree and acknowledge that:
        • in all circumstances, your Deposit will be forfeited and will be retained by Best 4 Travel;
        • you will become liable to pay us a Cancellation Fee equal to the commission which was to be earned by Best 4 Travel in relation to your Booking;
        • you will become liable for any Supplier fees which you agree will be dictated by the terms and conditions imposed by the Supplier (for example, if a Supplier’s terms and conditions contain a “no refund policy”, we will only be able to provide you with the remedy provided by the Supplier (if any) and which may include a travel credit supplied by the Supplier); and
        • if any aspect of the Booking was expressly stipulated being an “instant purchase” or a “non-refundable booking”, then you will not be entitled to any remedy from us or the Supplier (including a refund, travel credit or any other remedy whatsoever).
      • Cancellation by Supplier
        • Whilst we try to avoid it, Suppliers (over whom we have no control) may from time to time cancel all or part of a Booking. In those circumstances (unless as a result of any Unavoidable or Extraordinary Circumstances), we will make all reasonable endeavours to work with the Supplier to obtain alternative travel arrangements of comparable standard (if available) or, subject to the Supplier’s terms and conditions, a refund of all money paid by you in respect of the Booking. In these circumstances, you agree and acknowledge that:
          • our ability to be able to secure alternative travel arrangements of comparable standard is subject to availability and the Supplier’s terms and conditions and that, whilst we will endeavour to obtain a refund, if the alternative travel arrangements are of a lesser value, your entitlement to any refund of the difference in value will be subject to the Supplier’s terms and conditions;
          • if we are able to secure a full or partial refund, then:
            • you will be liable to pay us a Cancellation Fee equal the commission which was to be earned by Best 4 Travel in relation to your Booking;
            • you will become liable for any Supplier fees which you agree will be dictated to by the terms and conditions imposed by the Supplier;
            • we will be entitled to deduct any Unrecoverable Costs from the refund; and
            • the refund will be paid subject to clause 4.7 below.
          • Unavoidable or Extraordinary Circumstances
            • In the event of Unavoidable or Extraordinary Circumstances, your Booking may be materially modified or cancelled.
  • If your Booking cancelled due to Unavoidable or Extraordinary Circumstances, we will endeavour to obtain a refund or a credit from the Supplier but if we cannot obtain a refund or a credit, then we may offer you Best 4 Travel credits to a value equal to the value of your Booking less:
    • a Cancellation Fee equal to the commission which was to be earned by Best 4 Travel in relation to your Booking;
    • any Supplier fees which you agree will be dictated to by the terms and conditions imposed by the Supplier; and
    • any Unrecoverable Costs; and
    • any other amounts for which we are entitled to an indemnity under clause 4.8 below.
  • Refund
    • If you are entitled to a refund pursuant to this clause 4, you agree and acknowledge that:
      • all fees and charges payable under this clause 4 may be deducted from the refund by Best 4 Travel;
      • any refund may be provided in the form of a credit for future travel from the Supplier and/or Best 4 Travel (any Best 4 Travel credits are the subject to clause 5 of these Terms & Conditions). This is in the absolute discretion of the Supplier and/or Best 4 Travel:
      • all refunds are subject to, and conditional upon, the following:
        • in the case of funds paid to a Supplier, Best 4 Travel receiving the refund from the Supplier (which may take 16 weeks, or longer, dependent upon the Supplier processing time) and/or the refund being authorised by the Supplier;
        • in the case of funds being held by Best 4 Travel, the refund being authorised by the Supplier.
      • Indemnity

In the event of any modification, change or cancellation to a Booking, and notwithstanding any provision within this clause 4, you agree to indemnify us against any Supplier fee, cost, charge, or claim made against, or incurred by, us in relation to any Booking made on your behalf.

  • Australian Consumer Law

Nothing in this clause 4 shall be deemed to restrict, exclude, or modify your right to any remedy to which you are entitled under the Australian Consumer Law.

  1. Best 4 Travel Credits
    • All Best 4 Travel credits are valid for 12 months from the date of issue (Credit Term). The Credit Term may be reviewed at the discretion of a director of Best 4 Travel.
    • You may only redeem your Best 4 Travel credit during the Credit Term for one or multiple bookings for future travel. These Terms & Conditions will apply to any booking made using your Best 4 Travel credit.
    • If you initiate a credit card dispute or charge back with your finance provider for the return of monies paid for your Booking, you will not be eligible for a Best 4 Travel credit in respect of that booking. Best 4 Travel reserves its right to refuse, void, cancel, reject, or hold for review, your credit if we reasonably believe that you have initiated a dispute or chargeback for your Booking and also elected to receive a Best 4 Travel credit. If requested by Best 4 Travel, you agree to provide full and frank disclosure as to the status of any dispute or chargeback initiated by you and in doing so, you acknowledge that Best 4 Travel will rely on that disclosure.
    • By accepting a Best 4 Travel credit, you agree the Best 4 Travel credit is provided in lieu of any refund or remedy you might otherwise be entitled to in connection with your Booking and release Best 4 Travel from any and all claims and liabilities, without limitation, arising from or in relation to your Booking, your inability to complete the Booking, and/or any refund or compensation you might be entitled to in relation to cancelling your Booking.
    • Best 4 Travel reserves its rights to refuse, void, cancel, reject, or hold for review any credit mistakenly applied in an incorrect denomination or applied or procured, directly or indirectly, in connection with fraudulent actions or claims, compensation abuse or in connection with any violation of these Terms & Conditions. Best 4 Travel also reserves its right to any remedy, including disqualifying you from receiving a Best 4 Travel credit, if it suspects or determines that you have committed fraud or otherwise violated these Terms & Conditions.
  2. Frequent Flyer Or Other Loyalty Program
    • Please provide your membership details, including membership number, to your consultant, at the time of booking so as to include your loyalty program membership in your Booking. You may also need to show your proof of membership (i.e. membership card) to airline staff, and retain your boarding passes and a copy of your tickets.
    • Not all airfares accrue frequent flyer points; frequent flyer points are subject to the airfare purchased. Please contact your relevant loyalty program for the specific terms of your membership including benefit eligibility. We do not make any guarantees in relation to frequent flyer or other loyalty programs.
    • We recommend you retain your boarding passes to enable you to claim points from Supplier’s directly.
  3. Passports, Visas & Other Entry Requirements
    • It is important that you ensure that you have valid passports, visas and re-entry permits which meet the requirements of immigration and other government authorities. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility.
    • For more information regarding visas, passports, and other travel document requirements for your trip, please contact your consultant. Please note, we can only provide you with general information on visa and passport requirements that apply to international travel bookings you make with us.
    • We do not warrant the accuracy or suitability of information provided by any external service provider and accept no liability for any loss or damage which you may suffer in reliance on it (except to the extent caused by fault on our part).
    • Passports

A valid passport is required for all international travel Bookings; most countries require your passport to be valid for six (6) months from the date of return and some countries require a machine-readable passport. It is your responsibility to ensure your passport is valid; unless otherwise advised, we will assume all travelers on a Booking have a valid passport for the relevant destination and any transit points. Please inform your consultant if this is not the case.

  • Visas
    • It is your responsibility to ensure you obtain and have any necessary Visa or other documentation required for your Booking and the destination countries, as well as re-entry to Australia. We recommend that you contact the embassy or consulate of your destination if you have questions about any required Visa or its application process, as well as entry and exit requirements for that destination.
    • Best 4 Travel does not take any responsibility for any failure to obtain the correct documentation.
  1. Travel Insurance
    • We strongly recommend you take out appropriate travel insurance for your travel arrangements at the time of booking; your insurance should at the least cover cancellation, medical and repatriation expenses, personal injury and accident, death and loss of personal baggage and money and personal liability insurance. Your consultant can provide general information to you about travel insurance and, upon request, provide a quotation for our recommended travel insurance provider.
    • We are an authorised representative of CoverMore Insurance Services Pty Ltd (ABN 95 003 114 145) (CoverMore) and receive financial and non-financial benefits when you buy CoverMore travel insurance products through us. We and CoverMore are authorised to provide you with general advice about, and arrange, travel insurance products on behalf of the insurer, Zurich Australian Insurance Limited (ABN 13 000 296 640, AFSL 232507). You must read the CoverMore Combined Financial Services Guide (FSG) / Product Disclosure Statement (PDS) before you decide to buy the CoverMore travel insurance product you are considering purchasing to ensure it meets your needs and financial situation. The Combined FSG/PDS also contains information about the conditions, limits and exclusions that apply to the insurance, the 15 working day cooling-off period, and how you can access CoverMore’s privacy policy and complaints handling procedures
    • We may also discuss alternate travel insurance providers with you, however, please note that:
      • if we discuss your travel insurance needs, please note that it is your responsibility to provide your consultant with all relevant information, including any relevant condition, which may affect your travel insurance;
      • the details of the services that travel insurers provide, including a quote, are contained within the travel insurer’s FSG and/or PDS and it is your responsibility to read and consider the applicable terms and conditions of the insurer, including the FSG and/or PDS before purchasing the travel insurance product;
      • we do not warrant the accuracy or suitability of any travel insurance product; and
      • if you purchase any travel insurance through us, we may receive financial and non-financial benefits as a result.
    • With any travel insurance, whether purchased through us, please note that the information we provide is on general in nature and we do not warrant the accuracy or suitability of any travel insurance product.
    • If you purchase travel insurance elsewhere, an additional service fee may be charged if we are required to provide any documentation to the third-party provider.
  2. Travel Advice
    • It is your responsibility to acquaint yourself with all relevant travel information, including applicable health risks.
    • You acknowledge that you are choosing to travel at a time where you may be exposed to COVID-19, and your decision to travel is made based on your own consideration of this information, and you acknowledge and agree that you are aware of, and assume responsibility for, the risks associated with traveling at this time. To the fullest extent permitted by law, we accept no liability in relation to these risks.
    • We recommend that you:
      • contact the Department of Foreign Affairs and Trade or visit their website at smartraveller.gov.au for general travel advice, as well as specific advice (including safety alert levels) relating to your travel destination(s). You can also register your travel plans with DFAT, so that you may be more easily contacted in an emergency; and
      • familiarise yourself with the current status of Australia’s COVID-19 immigration and border arrangements by visiting their website at https://covid19.homeaffairs.gov.au, as well as relevant airline passenger safety requirements (including the airline’s requirements, if any, to wear a face mask and to produce evidence of a negative COVID-19 test).
  1. Health
    • It is your responsibility to ensure that you are aware of any relevant destination, government and/or Supplier health requirements (including but not limited to vaccinations, testing, documentation, and quarantine periods), recommended precautions and that you carry all necessary vaccination documentation. In some cases, failure to meet health requirements may deny your entry into a country or you may be refused boarding by a Supplier.
    • We recommend that you consult with your local doctor, travel medical service or specialist vaccination clinic before travelling.  General health advice for the destination you wish to visit is also available from Department of Foreign Affairs and Trade. For more information, see gov.au.
    • We will do all things reasonably practicable to accommodate any medical requests made by you, including, but not limited to, power access, refrigeration, and travel mobility aids. However, we cannot guarantee your request will be accommodated because all medical requests are beyond our control and subject to the absolute discretion of the Supplier. It is your responsibility to confirm with Suppliers directly to confirm any medical requests.
  2. Financial Arrangements
    • We are remunerated through commissions, financial incentives and other means from booking travel and travel-related products and services made on your behalf with Suppliers. We are not required to disclose the nature or value of these financial arrangements, nor will we.
  3. Limitation of Liability
    • To the extent permitted by law, neither Best 4 Travel, nor any of its related bodies corporate, directors, officers, employees, servants or agents accept any liability in contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control, force majeure or any other event which is beyond our control or which is not preventable by reasonable diligence on our part.
    • Where our liability cannot be excluded and may be lawfully limited, such liability is limited to the remedies required under applicable law (including the Australian Consumer Law) and shall not exceed the total of the commissions payable to Best 4 Travel and the service fees charged by Best 4 Travel, being the sums for which Best 4 Travel is entitled to be paid in connection with the provision of the Services.
    • This clause is subject to your rights under the Australian Consumer Law and nothing in these Terms & Conditions is intended to limit any rights you may have under the Competition and Consumer Act 2010(Cth).
  4. Agency Relationship
    • Best 4 Travel acts as an agent for, and sells Products as an agent on behalf of, its Suppliers. Any Booking, advisory and other service we provide to you are collateral to that agency relationship.
    • Our obligation to you is to make travel bookings on your behalf and arrange relevant contracts between you and the Suppliers. We exercise reasonable care in the selection of reputable Suppliers, but we are not ourselves a provider of travel services and have no control over, or liability for, the services provided by third parties or our Suppliers.
    • All Bookings are subject to the terms and conditions, including conditions of carriage and limitations of liability, imposed by the Supplier. We can provide you with copies of the relevant Supplier’s terms and conditions on request. However, as Supplier’s can amend said documents at any time, we do not warrant the continued validity or currency of any copies provided and accept no liability for any loss or damage which you may suffer in reliance on it (except to the extent caused by fault on our part). Your legal rights in connection with the provision of travel services are against the specific Supplier and, except to the extent a problem is caused by fault on our part, are not against us. Specifically, if for any reason (excluding fault on our part) any Supplier is unable to provide the Services for which you have contracted, your rights are against that Supplier and not against us.
  5. Variation
    • We reserve the right to modify any of these Terms & Conditions at any time without prior notice.
    • If we make changes to any of these Terms & Conditions, we will publish the amended Terms & Conditions on our website, applications, or services, which are effective upon publishment.
    • The applicable terms that apply are those in effect at the time you make your Booking (including by using any credit or voucher) with us.
  6. Australian Consumer Law
    • These Terms & Conditions are subject to your rights under the Australian Consumer Law and nothing in these terms and conditions is intended to limit any rights you may have under the Competition and Consumer Act 2010 (Cth).
  7. Governing Law
    • If any dispute arises between you and us, the laws of Western Australia will apply. You irrevocably and unconditionally consent and submit to the exclusive jurisdiction of the courts of Western Australia and waive any right that you may have to object to an action being brought in those courts.
  8. Definitions
    • We”, “us”, “our”, and “Best 4 Travel” mean Braid Road Pty Ltd trading as Best 4 Travel (ABN 24 660 536 201).
    • Booking” means the Quotation, Itinerary and the Total Price.
    • Cancellation Fee” means the cancellation fees payable in accordance with clause 4 and specified in the Booking.
    • Deposit” means the non-refundable deposit payable as the first instalment of the Total Price, with the balance of the Total Price payable at a later date, to secure your Itinerary (but not the Total Price).
    • Itinerary” means the itinerary and related reservations made by us on your behalf in accordance with your instructions.
    • Product” means the service or product provided by a Supplier, for example, an airline or a hotel.
    • Quotation” means the Booking prior to the Deposit having been paid.
    • Service Fee” means the cancellation fees payable in accordance with clause 4 and specified in the Booking.
    • Services” means services provided by us to you in assisting you to purchase a Product from a Supplier and includes advisory and consulting services and providing a facility to enter transactions with us and Suppliers (whose details and Products may appear on our website, brochures, or other advertising).
    • Supplier” means the company or person who provides you with the Product on terms and conditions agreed with you which includes, but is not limited to, transport, accommodation, and other service providers, such as airlines, coach, rail, and cruise line operators, as well as all of our wholesalers.
    • Unavoidable or Extraordinary Circumstances” means any cause outside Best 4 Travel’s or a Supplier’s reasonable control which could not be prevented or avoided including, but not limited to, war, threat of war, riot, civil disturbances, industrial dispute, terrorist activity and its consequences, plague, epidemic, pandemic, infectious disease outbreak or any other public health crisis (including quarantine or other employee restrictions), natural or other disaster (such as volcanic ash or hurricanes or similar events), nuclear incident, fire or bushfires, adverse weather conditions (actual or threatened, including snow and fog), closed or congested airports or ports or other modes of transport, unavoidable technical problems with transport, unforeseen alterations to transport schedules, transportation disruptions or cancellations, domestic and/or international travel restrictions, changes to travel advisories and restrictions, changes to health advisories and quarantines, changes to immigration, labour and free-movement laws resulting from BREXIT, rescheduling of aircraft or boats or other modes of transport, changes to applicable laws and/or other government mandates (including evacuation orders and border closures), and similar events.
    • Unrecoverable Costs” means all reasonable, direct and indirect costs we have incurred in relation to your Booking, and includes amounts paid by Best 4 Travel to other relevant travel service providers who are responsible for components of your Booking and which may be non-refundable (for example, costs paid to overseas tour or transfer company).
    • Total Price” means the price for the Itinerary.
    • You” means any user of our website and includes any person who makes a Booking and/or purchases a Product (whether or not the Services and/or Product were acquired by another person).
